FSSAI’s big action on Swiggy, issued 9 notices after customer complaints

Swiggy Instamart FSSAI Notice: Online food delivery company Swiggy is once again in the news. The Food Safety and Standards Authority of India (FSSAI) has issued 9 notices to Swiggy Instamart in a case related to alleged violation of the Food Safety and Standards Act 2006. These notices have been sent on the basis of continuous complaints received from customers alleging delivery of expired, rotten, contaminated and inedible food products.

FSSAI has sought detailed explanation from the company along with documents on all the allegations and a report on compliance with the rules. It has also been clarified that if response is not received within the stipulated time, legal action can be taken under the Food Safety and Standards Act 2006.

9 notices issued on the basis of which complaints?

  • Customers complained that expired, rotten, contaminated and unsafe food products for human consumption were delivered through Swiggy Instamart.
  • According to FSSAI, Noise Eggs were being sold under a brand name which was not part of the product category approved in the company’s existing FSSAI license. The authority directed that this product should not be sold until a valid license is obtained and the license should be amended if necessary.
  • It was said in the complaints that products like Healthify 100% Whey Protein 1 kg and Noice Home Style Madras Mixture with Peanuts were delivered to the customers even after the expiry date.
  • Complaints were received about Akshayakalpa Organic Egg that the eggs were expired, rotten, smelly and contaminated, making them unfit for consumption. Despite the complaint being escalated, no corrective action was reportedly taken.
  • In another complaint, it was said that Kake Da Paratha was delivered in bad and smelly condition. Despite the complaint, it was also alleged that no appropriate action was taken.
  • A complaint was registered that an infant food formulation was found in bad, contaminated and unsafe condition. It is alleged that even after the customer returned the defective product, the same defective product was sent again.
  • FSSAI has also received complaints alleging delivery of contaminated eggs, spoiled milk and torn or damaged packed food items to customers.
  • The notice also said that in some cases wrong, invalid or erroneous FSSAI license numbers were used. Also, some food business entities were found listed with names that did not match their FSSAI registration.
  • It was alleged in many complaints that even after the complaint was registered and escalated, no satisfactory response, grievance redressal or positive action was taken. In one case, the case was closed only by giving a refund, while the issue related to food safety was not resolved. FSSAI also raised questions on the adequacy of vendor on-boarding, compliance verification, traceability, food quality monitoring, consumer complaint redressal and food safety systems.

What did FSSAI demand from Swiggy Instamart?

The food regulator directed the company to give a detailed reply with documents on all the allegations. Apart from this, complete information related to quality control, food safety monitoring, inventory management, stock rotation, storage, handling and additional controls was provided. FSSAI also asked the company to submit details of root cause analysis of each case, details of collective and preventive action taken to resolve consumer complaints and steps taken to prevent such incidents in future. If compliance report is not submitted within the stipulated time, further action can be taken under the Food Safety and Standards Act 2006.
