Delhi High Court, while hearing the petition seeking stay on the release of the film ‘Blackbuck – The Battle for Legacy’, has asked film actor Salman Khan that just because he wears a bracelet like an actor or shows some similar things, it cannot be considered as the identity of that actor. Do personality rights also extend to the promotional content of a film?

Delhi High Court remarked during the hearing that if someone wears a bracelet, ties a turban or wears a watch, will that also be considered the right of any one person?
Salman’s claim- use of my identity without permission
It was argued on behalf of Salman Khan that the producers of the film want to take commercial advantage by using his image and identity. He said that the film is inspired by the famous black buck hunting case of 1998 and the controversies related to gangster Lawrence Vishnoi. Therefore, the release of the film and its teaser should be banned.

Delhi High Court said – mere gestures are not enough
The lawyer argued that the bracelet of the main character of the film and some other things match the identity of Salman Khan. The interview of the film’s director was also cited. But the court said that on the basis of such indications alone it does not prove that the film is directly based on Salman Khan. The court said that real and clear relationship has to be shown and the ban cannot be imposed merely on the basis of presumption.

When Salman’s side also mentioned the earrings and other accessories of the film’s character, the court made a strict comment and asked whether personality rights should now be applied to wearing bracelets, earrings and watches also. The court said that giving such an order was unimaginable and asked whether any such legal precedent existed.

The court also banned new arguments
During the hearing, Salman’s side also wanted to mention some interviews and social media posts which were not included in the application. On this the court clearly said that it will consider only that application which is on record. The scope of the arguments cannot be expanded by adding new material later.
Now filmmakers will show videos
The court has directed the film producers to upload the videos mentioned in the petition. Provide their copies to Salman Khan’s lawyer so that their authenticity can be verified. The next hearing of the case will be held on July 7 at 2:30 pm, where further debate will be held on the demand for a ban on the film’s release and teaser.
