India AI Law: AI has been changing continuously and very rapidly in the last few years. Along with countless benefits, some concerns are also emerging regarding this technology. In view of these, the central government can bring a new law. In this, provisions will be made to prevent misuse of AI in social media and cyber space. The proposed law may cover issues like deepfakes, online scams, privacy issues, copyright problems and fixing responsibility if AI systems cause harm. The IT Ministry says that the existing rules cover some of the problems related to AI, but new issues are also continuously emerging.
Why is there a need for a new law?
According to reports, the government believes that the existing laws were brought keeping in mind human behavior and do not include the way AI works. These laws can handle many problems related to AI, but these laws were not designed for this. IT Ministry Secretary S Krishnan said that the current laws can handle issues like deepfakes and content labeling to some extent, but they are not enough to deal with the risks related to AI. He has confirmed that the government is in talks with experts on bringing a legal framework for AI.
Responsibility for AI’s mistakes is not fixed in the current laws.
There is no clarity in the current laws applicable in India as to who will be held responsible if AI commits any mistake. In fact, even the companies that develop AI cannot explain why a system has taken a particular decision. For example, if an accident occurs due to a self-driving car or something goes wrong while an AI robot is performing surgery, then the current law is not clear whether the company, the user or anyone else should be held responsible for this. Similarly, there is a need for clarity in the matter of copyright and data also.
Government also worried about deepfake videos
Along with all other issues, the government is also concerned about the use of AI in creating deepfake videos and cloned voices and this issue is being considered continuously. Deepfake video and audio clones pose a big threat of fraud and identity theft. Such content also goes viral rapidly on social media. In such a situation, even before any action is taken against a video or audio clip, it has already reached millions of people.
